Clamping a vehicle on private land

April 18th 2018.

Given a recent court judgment on this subject, we are in the process of updating this page.

This particular subject is one that we receive so many enquiries about. In the first instances, the  Taking Control of Goods Regulations 2013 specifically provide that a bailiff/enforcement agent may clamp a vehicle at the debtors property or on a highway.

Is my driveway considered private land?

No, the warrant of control allows a bailiff/enforcement agent to take control of goods from your property and this would include your driveway
